Terms of Service

1. Acceptance of Terms

By accessing or using LearnWhat.ai ("the App," "Service," or "we"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes your acceptance of the new Terms.

2. Description of Service

LearnWhat.ai is an AI-powered mobile application that helps users create flashcards from their notes, images, and text. The App uses artificial intelligence to generate educational content and provides study tools including:

  • AI-generated flashcard creation from uploaded content
  • Study session tracking and progress monitoring
  • Pre-made content packs for various subjects
  • Smart answer validation

3. User Accounts

3.1 Registration

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. Subscriptions and Payments

4.1 Subscription Plans

LearnWhat.ai offers the following subscription tiers:

  • Free: Limited features including 5 sets per month, 2 images per set
  • Premium ($4.99/month): 50 sets per month, 5 images per set, ad-free experience
  • Pro ($9.99/month): Unlimited sets, 15 images per set, ad-free experience

4.2 Billing

Subscriptions are billed through the Apple App Store. By subscribing, you agree to the payment terms presented to you at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

4.3 Refunds

Refunds are handled according to Apple's App Store policies. Please contact Apple Support for refund requests.

5. User Content

5.1 Your Content

You retain ownership of all content you upload to the App ("User Content"). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing the Service.

5.2 Content Restrictions

You agree not to upload content that:

  • Infringes on intellectual property rights of others
  • Contains illegal, harmful, or offensive material
  • Contains malware or harmful code
  • Violates any applicable laws or regulations

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, to be inappropriate.

6. Intellectual Property

The App, including its design, features, and content (excluding User Content), is owned by LearnWhat.ai and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

7. AI-Generated Content

The flashcards and educational content generated by our AI are provided for informational and educational purposes only. While we strive for accuracy:

  • AI-generated content may contain errors or inaccuracies
  • You should verify important information from authoritative sources
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content

8. Prohibited Uses

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App or its servers
  • Use automated systems to access the App without permission
  • Reverse engineer or attempt to extract the source code
  • Use the App to compete with us or create a competing product

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEARNWHAT.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless LearnWhat.ai and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
